Registration of trademark in Spain

Registering own trademark in Spain is a sufficiently popular idea, because the country does not have too high taxes for doing business. Due to the specific location of the state, three registration options are available there, namely:

  • through national offices;
  • through the European Union Intellectual Property Office, which is located in Alicante;
  • through the international office according to the Madrid Agreement.

If you plan to use the brand in only one country, the easiest method is to register trademark in Spain through the national office. If violations were found out about at the stage of trademark verification, the applicant is given one month for correction. All decisions are published in the Official Bulletin of Copyright and may be appealed in due course.

Documents and terms of registration of trademark in Spain

Standard set of documents includes the following:

  • application containing information about the applicant, namely: full name of the natural person, name and description of the form of incorporation of the legal entity, copies of identification documents. It shall be submitted in Spanish;
  • copies of the image of the trademark, 15 pieces: color or black and white;
  • list of necessary spheres of activities;
  • financial documents concerning payment of corresponding fees.

It is also possible to pay an additional fee and submit a request for accelerated consideration of the application. The average term for issuing the certificate range from 8 months to one year. The issued registration is valid for 10 years, and afterwards it can be renewed unlimited number of times.
