Registration of trademark in Costa Rica

The small state of Costa Rica in Central America is quite attractive in terms of doing business and taxation. There is regional system for protection of intellectual property in the country. Documents of title are issued only after verification by the country database.

At the same time, the Costa Rican Patent Office considers that the Certificate on registration of trademark is mandatory only for pharmaceutical goods. Registration of such trademark shall come into effect immediately after the publication of the relevant information in the official bulletin “La Gaceta”.

Trademark registration procedure in Costa Rica

Insufficiency of protection of intellectual property in the country is compensated by the Patent Cooperation Treaty, which is the basis of the PCT system, in which Costa Rica, in addition to other states, participates.

The capabilities of the foregoing system make it possible to ensure cost-efficiency and simplicity of the procedure for submitting application to one Office, using any of the languages recognized as official.

In order to register trademark in Costa Rica, the package of documents is verified for its completeness and compliance with the requirements for registration.

Such verification is considered as formal examination, which certifies availability of the application that should contain:

• Information about the applicant and his address;

• Description and qualitative image of the designation;

• List of classes according to the ICGS.

One copy of the application shall be mandatorily sent to the WIPO, and one more copy shall be submitted to the International Search Authority.

Moreover, the applicant, who tends to assure himself of the trademark's protectability, has the right to apply for the provision of International Preliminary Examination Services.

Upon the expiry of 18 months, when the conducted examinations (formal and substantive) confirms compliance of the application with all rules, international publication of information about the application is carried out.
