Registering a trademark in Algeria

If you decided to do business not only in your country, but also abroad, then registration of your trademark will be required in order to present your products. There are two options for resolving this issue, namely: registering trademark in all countries where you plan to do business, or carrying out international registration.

In addition, there is the possibility of international registration in Algeria, since the country is party to the Madrid Agreement.

Registration of trademarks in Algeria is carried out by the National Institute of Algerian Industrial Property, which reports to the Ministry of Industry of the country. The application should be submitted to the NIAIP’s trademark office. Word, design, phrase, name, logo, symbol or combination of all or several of the indicated elements can act as trademark.

In order to TM to be registered in Algeria, the following documents should be submitted:

• passport;
• Design and word mark of the trademark, with the translation of the words used;
• Description of goods or service provided;
• Printed copy of the trademark;
• Signed and stamped power of attorney.

It is necessary to indicate full list of goods and services for which the trademark will be used, as well as the classes of the ICGS corresponding to them in the application for registration of trademark. The exclusive right extends only to the goods and services specified in the certificate of registration.

The entire procedure for registration of trademarks can range from 4 to 6 months. In Algeria, registration system is applied, which provides for the lack of examination proceeding on the merits of the trademark. Trademarks are registered and published in the Bulletin "de la Propriete Industrielle".

As no other country, Algeria provides for filing claims within five years since filing of the application. During this period, third parties may file claims. However, despite such a long period, there are almost no claims. The period of validity of protection is 10 years. Subsequently, unlimited number of renewals is possible, also for 10 years.
