Rules for registration of TM in Azerbaijan

The country belongs to the number of participants in the Madrid Agreement and the Protocol, therefore, there are two systems of registration of trademarks: national and international.

1. Registration of a trademark according to the national procedure guarantees full protection of the legal rights of trademark in accordance with the rules of the Paris Convention, as well as its free use within the borders of Azerbaijan. For registration of TM in neighboring countries, a re-submission of the documentation package and the application will be required.
2. International procedure gives an entrepreneur the opportunity to develop business in 97 countries of the world after the approval of one application. The system has a high level of requirements for graphic representation of TM: particular logo is compared with the emblems of all companies from the register of the Agreement and must comply with the legislation of each of the participants in the Protocol.

When creating a layout of TM, it is unacceptable to use immoral or insulting elements, names of famous persons or names of large corporations without their personal written permission. Both an individual and an owner of an operating business can be submit an application. Depending on the type of counterparty and the chosen registration procedure, the list of required documents is changed, as well as approximate terms for consideration of the application can be changed.
