Registration of trademarks in Montenegro

Montenegro has adopted legislation that regulates the registration of trademarks in the territory of the country. Independent examination of similarity and identity of the trademark is not required for registration. It is enough to carry out the examination for compliance with the formal and general requirements of the trademark.

The registration of applications in Montenegro is carried out by the Institute of Intellectual Property. Submission of the application is carried out according to the form issued by the Office, in addition, payment of the fee for registration and examination of the application is required. The period of verification of the application may take up to several months.

After verification and registration of the application, the official publication of the trademark data is carried out. After that, the persons who have objections to the published trademark have the opportunity to challenge the application within 3 months. The foregoing method of registration is called an "opposition system".

In case there are no objections from the right holders of trademarks, the certificate of registration of the trademark is issued. It operates in the territory of Montenegro, as well as in the territory of Bosnia and Herzegovina and Serbia. But the only requirement is that the application should be translated into Serbian.

Additional payment for the expansion of the territory of the trademark operation is not required.
